This paper will first look at the perceived problems that were to be addressed by the strategy in terms of the innovation gap and why the developing regions seem to be lagging behind where access to medicine is concerned. It will also explore the link that has been established between accessibility and the ability to protect intellectual property, and encourage innovation. The key elements of the strategy, including how these are to be prioritised will then be looked at, to ascertain which are likely to encourage such innovation and the legal provisions that are likely to be formative in achieving this. Much of this has been encouraged by the HIV pandemic taking place in the developing countries at a much more serious rate than that the experience of the more developed locales[4]. With this in mind and in the context of the introduction of the World Trade Organisation Agreement on trade related aspects of intellectual property rights by offering patent protection to pharmaceutical products, there is increasing attention being placed on issues relating to the availability and pricing of the essential medicines[5]. The issue of dealing with the innovation gap and the resulting gap in the availability of medicines between the developing and developed regions is something that emerged during the 2008 strategy and is also central to the research undertaken by the Commission on Health Research and Development, back in the 1990s, where commitments were made as part of the millennium development goals to ensure that activities would be undertaken to benefit some of the poorest countries in the world; for example, encouraging donations from both public and private sectors, in order to ensure that these countries were able to undertake their own research and development, thus reducing any disparity that existed within global health. Despite this commitment, the innovation gap remains, and this has led to the establishment of the 2008 strategy. Since the establishment of the 1995 World Trade Organisation protection of intellectual property rights relating to pharmaceutical products, there has been an ongoing tension between the ability of commercial organisations to achieve financial success as a result of patenting pharmaceutical products and the need to ensure consistent global health services. This tension was such that, in 2003, it was decided by the World Health Organisation that it was necessary to obtain the advice of an independent expert commission[6]. As a result, the Commission on Intellectual Property Rights, Innovation and Public Health established that there are key policy measures that need to be created, in order to fill in the gaps which have emerged in this area and to deal with the ever increasing disparity in health care services. In particular, the commission focused on the gap that existed in the innovation cycle. The commission saw the crucial step of breaking down the innovation cycle as a means of l ooking at the various stages of bringing medicines to the market and, critically, identifying any weaknesses within the developing regions that emerge as part of the innovation cycle. When looking at countries that have made essential innovative improvements, it is possible to identify more accurately how the developing countries could potentially improve in the future, so as to ensure that appropriate medicines becomes available on a needs’ basis, rather than on an economic basis. Recommendations were made on policy improvement in the area and as such the Working Group on Public Health, Innovation and Intellectual Property was established[7]. The group worked with the notion that the development of innovation is a complex process and requires a wide range of policy areas to be considered including the actual scientific and medical fields, but also taking into account social, economic and historic factors, all of which are likely to be relevant when it comes to the underlying success of policy initiatives. Despite this, the focus remains on the concept of pharmaceutical innovation, which looks at the process of discovering, developing, producing and delivering medical products, as and when people require them. Each of these four steps is potentially relevant when considering why certain groups in certain countries do not achieve an acceptable level of health care. Any blockage at any of these stages will have a detrimental impact on the ability of individuals to be treated on a needs’ basis. By using health innovation as an ongoing cycle, several critical practical realities need to be considered[8]. Firstly, it is noted that any form of health innovation will continuously lead in to further health innovation and therefore it will be necessary for experts to have access to previously gained knowledge, before they can then develop this into new knowledge. Secondly, it is also noted that the development of new drugs in isolation is insufficient, as a health infrastructure is required in order to ensure that the correct people have access to the medical care that is produced. This is often perceived to be an underlying problem of intellectual property, in itself, as it may be possible for an individual within an industry to develop a new product or new process, but it is ensuring that this new product or process enters the market which ultimately makes it commercially viable. The health innovation market is no different and, whilst it may be possible for key individuals to develop new innovations, if there is no structure available to ensure that everyone gains access to these medicines, the cycle is broken and the underlying goal of the WHO is not achieved[9]. Therefore, in the developing regions, there is the difficulty, not only of lacking potential technical expertise to develop the drugs, but also of being unable to develop, produce and distribute any medical advancement, which will ultimately block the ability of key individuals to receive the treatment they require based on need. Each of these is considered briefly, in order to identify the impact that they have had on the overall development of the ability of developing countries to utilise health innovation in such a way that will benefit the necessary groups of individuals. Prioritising research and development needs: starting at the outset of the health cycle, the WHO ensured that a better understanding of the health needs of developing countries was required, so that any research and development is focused on these key areas. This crucial stage is vital when identifying neglected diseases as, without identifying the diseases to be targeted, it is difficult to ensure that appropriate innovation takes place. Promoting research and development: although there are multiple different ways of determining the innovative capacity of a particular region, the WHO feels that those responsible for ensuring that neglected diseases in the developing countries are managed more effectively should receive enhanced support to bring their research and development more in line with the developed regions. Building and improving innovative capacity: effective policies and regulations that will promote any abilities and capabilities that are emerging within the developing countries for health innovation; for example, allowing developing countries to undertake their own clinical trials and improving intellectual property protection, as well as the local production of pharmaceuticals. Technology transfer: a large amount of the focus here is placed on ensuring that capacity is noted in the developing regions for policies which also recognise that technology transfer and development is a key way in which the developing countries can gain at least some benefit from existing technologies in other regions[10]. For example, the TRIPS Agreement offered specific incentives for developed countries to work alongside developing regions; therefore, these incentives need to be reviewed, in order to ensure that they are sufficiently strong to encourage and develop countries to transfer technology wherever possible[11]. Application and management of intellectual property: there needs to be recognition that there is a requirement to strengthen capacity to allow intellectual property to be developed within developing regions. It has been proposed by the WHO that there needs to be a review of the application of intellectual property rights within health innovation, to offer incentives to promote the use of intellectual property in the developing countries, even where it may not be immediately perceived to be commercially beneficial. Improving delivery and access: as noted at the outset, establishing health innovation is merely one step in the innovation cycle and there needs to be a strong infrastructure in place to ensure that mechanisms are available to ensure that quality medicines are made available directly to those people who require them, at the correct time, with this being inherently linked to pricing and taxation. Ensuring sustainable financing mechanism: this core element looks more towards the long-term impact on the provision of healthcare services within the developing countries. Whilst there are often substantial financial injections into the developing countries, this needs to be made on a more sustainable footing in order to ensure that there are no substantial gaps in the financing of research and that the development cycle is continuous. Establishing a monitoring and reporting system: the final stage of the focus is to ensure that ongoing monitoring takes place and any potential gaps identified at the earliest opportunity, so that other aspects of the policy can be tweaked in order to encourage appropriate behaviour from both the developing countries themselves and also commercial organisations elsewhere which regularly interact with the developing regions, particularly when it comes to the provision of intellectual property and health innovation.   Ongoing Monitoring on Impact Having set out the various different policy approaches, it is proposed here that, if these were to be effectively applied, the developing countries would be in a much stronger position to ensure that health innovations are developed securely in relation to neglected diseases and are more readily available to those in need[12]. However, the strength of these policies really lies in their implementation and whether or not implementation has been successfully achieved, on a practical level. For this reason, the latter stage of this analysis looks at monitoring and evaluating the impact of these policies[13]. By looking in more detail at the area of the policy that is focused on establishing a robust monitoring and reporting systems, the WHO suggests that four areas need to be monitored, specifically. These include, the gap that exists in terms of health products and medical devices; the impact that intellectual property has on all aspects of the policies under scrutiny; the impact of any incentive mechanisms for transferring technology between the developed and developing regions; and finally, the level of investment in research and development, particularly in the developing regions[14]. The key difficulty when it comes to monitoring the impact of the strategy has been that it requires interactions among a variety of different entities, not all of whom are within the health sector. For example, it is necessary to look at the various political and economic issues, as well as goals, in order to gain an understanding of how effective the strategy is proving, from a practical perspective. When looking at this from a legal perspective and in particular the TRIPS Agreement, it can be seen that there are elements of incentives offered to ensure that developing countries are able t to attract at least some element of intellectual property development[15]; however, these need to be looked at in more detail, to encourage greater practical application, if the WHO strategy is to be successful and the gap between developing and developed countries is not to increase to an unsustainable level. Track State Championship Essay -- Memoir Essays

Track State Championship The pit of my stomach felt as if it was being eaten away by gnawing insects inside. It wasn't just the ordinary butterflies but evil-biting insects. I was standing impatiently on the track quickly sliding further toward the inside as the incoming runner completed her handoff. Screaming encouragements, I waited for Rachel to make her way down the last stretch. We successfully completed our exchange of the baton and I was off. We arrived at Dutch Clark Stadium in Pueblo, Colorado our normal two hours early on a dark, rainy Friday morning. Our team carried in the large tarp, blue tent, coolers full of energy food and many cases of water to keep us hydrated throughout the day. The sight of the enormous red rubber track brought that familiar tingle to my stomach. "It's the same size as any other track, but we just run the opposite direction," I heard Coach Dirst joke with the always gullible Erin. Shortly after we set up camp, I heard the familiar words, "Get out of here!" come from Coach Dirst. Our team made our way down the mountain of unevenly spaced, concrete stairs to the track. After doing our routine warm-up of a two-lap jog, stretches and form running, the team scattered, some preparing for their event, others just hoping to catch a few more zs. As I was making my way back to camp, I noticed everyone's red stained t-shirts and sweatshirts from stretching on the damp track, not realizing those stains would in time become memories I'd never forget. The day of prelims jumped off to a great start. The medley relay qualified for finals, and Kendal became a two-time state champion in high jump capturing the team's first ten points. The rest of the day went just as well. After placing fourth a... ...owerful! To hear Coach Dirst say that just made the whole experience that much more special. All the hard work we'd put in throughout the year had finally paid off when it mattered most. As we ran our final victory lap of the 2002 track season, we realized we had accomplished what every team dreams. After the sharing of many hugs and tears, happy ones of course, I made my way back to camp to gather my belongings. I then slowly strolled to the parking lot wanting to savor the incredible feeling. As I gazed up at the pitch-black sky, a raindrop fell to my forehead. Within no time at all, I was standing in the midst of a downpour taking everything in as I thought, "This is as good as it gets!" All the emotions, triumph, thrill and excitement, I was feeling acted like a bug bomb to the evil-biting insects that were at one time eating away at the pit of my stomach. Â

Often when we communicate there is always an overall power within that communication. The speaker may create the status of ring leader. This power throughout communication may be seen as a strength, as they are leading the conversation, however this power may be perceived negatively. The recipient in the conversation may feel small and belittled as there is no chance for them to talk, this may therefore cause communication to be less effective. In health and social care both the care provider and patients have power. The patient would have power over final decisions that need to be made concerning their care, however the care provider would have power over the level of care given. This balance of power should always be shared positively. Power throughout communication plays an important role. The care giver should always take the lead. It is important for the patient to have their say on any decisions that may be made, however if the care provider feels they are making the wrong deci sion they should use their all their power of medical intelligence to persuade the patient to make the right decision. Abuse of power may be seen in the workplace. As an example a care worker may be the subject of abuse) by senior management. The senior management may think that the care worker won’t tell anyone due to his or her higher status. This would be an abuse of power on their behalf as they are using their higher level of management to intimidate. This care workers communication throughout the job may also suffer due to their being in a vulnerable state. A strategy that may help any use and abuse of power being stopped may be to promote individual rights within the workplace. This could help to ensure everyone is clear of what help they could have. Putting staff in touch with trade unions may also help. In relation to the above-mentioned case study, an abused care worker might apply the strategy  of speaking to someone in higher management. If the care worker did not feel comfortable doing this, another idea might be to report it to a complaint company or the police. Reporting to higher management may be seen as a positive or a negative. The positive to this strategy is that fast action could take place to ensure the problem is resolved. However the negative could be that the situation isn’t kept private as each different manger might have to discuss it, this may in turn cause the care worker to feel embarrassed and unsafe. In conclusion I feel the use and abuse of power is a key consideration for the care worker and one that will certainly need to be applied strategically. The use of various strategies to meet various situations will create an image of the personality of the care worker in the eyes of their patient. The final factor which effects effective communication would be the use of alcohol and drugs. When having to care for persons under the influence of these substances the lack communication will become a great struggle and may cause great difficulties. A case study example could be in an A and E unit. If the carer is dealing with a person under the influence they would have to be very patient. The person receiving the care may be angry, the best way to defuse this anger is to make sure the person has enough space, if they feel overcrowded this may make them more angry as they are unaware of what is going on. As a carer you would ensure yourself to talk slowly, you may also find that you have to often repeat yourself. While communicating with someone who has drank or taken substances they may either be quiet and be struggling to talk or they may say things that don’t make any sense. As a carer you would try to make them understand where they are and what is going on. Reassuring may gain trust as they know you are only trying to help. If a carer had to undertake a procedure while the patient was under the influence communication would be key. Making sure the person understands what is happening and why is very important. If the person cooperates this will make the procedure a lot easier however there could be a possibility that the person may decide half way through the procedure that they no longer want it or as the drugs or alcohol are wearing off they may feel more confused. Confusion could cause the patient to become angry against the person who is caring for them. Their only defence mechanism they  may feel they have to defend their- selves may be to act physically against the carer. To help ensure this does not happen communication throughout the whole process is vital. However if the patient still reacts angrily having another carer there should ensure more safety. By making the patient aware of their surroundings could bring both negatives and positives. The positive side to this is the patient is aware of where they are, this may help by them being more comparative in any procedures that may need to take place. However this action could also be looked at negatively by telling the patient about their surroundings might make them not want to be there this may cause their cooperation to be poor. Receiving effective communication with a persons under the influence of drink and drugs can be proven difficult however talking slowly and using appropriate strategies should ensure the communication is as effective as possible.

The Gullah or Geechee Community The Gullah people of South Carolina and Georgia have a fascinating history and culture. Also known as the Geechee, the Gullah are descended from African slaves who were prized for their ability to grow crucial crops such as rice. Due to geography, their culture was largely isolated from white society and from other slave societies. They are known for having preserved a tremendous amount of their African traditions and language elements. Today, approximately 250,000 people speak the Gullah language, a rich mixture of African words and the English that was spoken hundreds of years ago. The Gullah are currently working to ensure that future generations and the general public know about and respect the Gullah past, present, and future. Geography of the Sea Islands The Gullah people inhabit many of the one hundred Sea Islands, which stretch along the Atlantic Ocean coasts of North Carolina, South Carolina, Georgia, and northern Florida. These marshy tidal and barrier islands have a humid subtropical climate. Sea Island, St. Helena Island, St. Simons Island, Sapelo Island, and Hilton Head Island are some of the most important islands in the chain. Enslavement and Atlantic Voyage Eighteenth-century plantation owners in South Carolina and Georgia wanted slaves to work on their plantations. Because growing rice is a very difficult, labor-intensive task, plantation owners were willing to pay high prices for slaves from the African Rice Coast. Thousands of people were enslaved in Liberia, Sierra Leone, Angola, and other countries. Before their voyage across the Atlantic Ocean, the slaves waited in holding cells in Western Africa. There, they began to create a pidgin language to communicate with people from other tribes. After their arrival in the Sea Islands, the Gullah blended their pidgin language with the English spoken by their masters. Immunity and Isolation of the Gullah The Gullah grew rice, okra, yams, cotton, and other crops. They also caught fish, shrimp, crabs, and oysters. Gullah had some immunity to tropical diseases like malaria and yellow fever. Because plantation owners did not have immunity to these diseases, they moved inland and left the Gullah slaves alone in the Sea Islands for much of the year. When the slaves were freed after the Civil War, many Gullah bought the land that they worked on and continued their agricultural way of life. They remained relatively isolated for another one hundred years. Development and Departure By the mid-20th century, ferries, roads, and bridges connected the Sea Islands to the mainland United States. Rice was also grown in other states, reducing the rice output from the Sea Islands. Many Gullah had to change their way of earning a living. Many resorts have been built in the Sea Islands, causing lingering controversy over ownership of the land. However, some Gullah now work in the tourism industry. Many have left the islands for higher education and employment opportunities. Supreme Court Justice Clarence Thomas spoke Gullah as a child. The Gullah Language The Gullah language has developed over four hundred years. The name Gullah probably derives from the Gola ethnic group in Liberia. Scholars have debated for decades over classifying Gullah as a distinct language or merely a dialect of English. Most linguists now regard Gullah as an English- based Creole language. It is sometimes called Sea Island Creole. The vocabulary is comprised of English words and words from dozens of African languages, such as Mende, Vai, Hausa, Igbo, and Yoruba. The African languages also greatly influenced Gullah grammar and pronunciation. The language was unwritten for much of its history. The Bible was recently translated into the Gullah language. Most Gullah speakers are also fluent in standard American English. Gullah Culture The Gullahs of the past and present have an intriguing culture that they deeply love and want to preserve. Customs, including storytelling, folklore, and songs, have been passed down through generations. Many women make crafts like baskets and quilts. Drums are a popular instrument. The Gullahs are Christians and attend church services regularly. Gullah families and communities celebrate holidays and other events together. The Gullah enjoy delicious dishes based on the crops they traditionally grew. Great efforts have been made to preserve the Gullah culture. The National Park Service oversees the Gullah/Geechee Cultural Heritage Corridor. A Gullah Museum exists on Hilton Head Island.
